If you are facing serious criminal charges, the bail process is one of the first measures that you will encounter. In Victoria, bail is common practice and the legal system has established a framework for granting bail to individuals charged with a crime.
As the circumstances of each case and each individual differ significantly, the application process, conditions, and considerations will change accordingly. Our experienced criminal lawyers will be able to provide expert guidance throughout all stages of the bail process.

Being charged with a crime can be a daunting experience. At Gallant Law, we understand the stress and uncertainty you may be feeling. Here's what you should do:
Remain Calm: Avoid making any statements to police without legal advice.
Seek Legal Advice Immediately: Contact an experienced criminal lawyer as soon as possible. We’ll advise you on the best strategy at the time of being charged and throughout the entire process.
Gather Information: Collect all relevant documents, such as police reports, court notices, bail papers and any intervention orders.
Meet with your lawyer: Discuss your version of events and familiarise yourself with your options and obligations.
Build a Strong Defence: Work closely with your lawyer to build a robust defence strategy and mitigate damage as much as possible.
Remember: Every case is unique, and the best course of action will depend on the specific circumstances. Gallant Law's experienced team can provide tailored advice and support throughout the legal process. We will protect your interests in and beyond the court room.
1. Criminal cases are complex with many legal nuances, no matter how ‘simple’ the charge may be: You could face significant penalties or ancillary orders. You might actually have a defence that you’re unaware of. There may be options to reduce the charge to something less serious.
2. Understanding of the law: The legal system has many rules and procedures. As does each court. A lawyer is trained to navigate these, and guide you through the many steps and requirements to make you feel informed and empowered.
3. Experience and Expertise: criminal lawyers have the experience and knowledge to determine the best strategies and defence, conduct persuasive plea negotiations, engage appropriate expert witnesses and manage other important features of your case.
4. Emotional and Psychological Impact: Being involved in a criminal case can be very stressful and frightening. A criminal lawyer can help alleviate some of the emotional burdens and anxiety.
Remember: Every case is unique. If you choose to represent yourself, it's crucial to thoroughly research the laws and procedures related to your case. Gallant Law's experienced team can provide tailored advice and support throughout the legal process. We will protect your interests in and beyond the court room. If you are unsure about your ability to pay for legal fees, speak to us about funding through Victoria Legal Aid.
Undertaking: The accused person agrees to comply with certain conditions without a financial guarantee or surety. This is typically granted when the accused person is considered a lower risk.
Bond: The accused person pays the full amount in cash. It is refundable once you attend all court dates and the case is finished.
Guarantee/Surety Bail: A guarantor (such as a family member or friend) puts down a “guarantee” (usually a deposit of money or other security such as real property) to enable an accused person to be released on bail. The guarantee may be forfeited if the accused person fails to appear at court or breaches bail.
Conditional Bail: Released with specific conditions, such as not contacting certain people, residing at a specific address or reporting to police.
3. Factors Affecting Bail:
Crime Severity: Serious crimes often mean higher bail or no bail.
Criminal Record: A history of crime can impact bail decisions.
Flight Risk: If you’re seen as likely to flee, or failing to appear at court, bail may be denied or conditions more onerous.
Community Ties: Strong ties to the jurisdiction, such as a job, family or owning a house can help with getting bail.
Remember: Every case is unique, and the best course of action will depend on the specific circumstances. Gallant Law's experienced team can provide tailored advice and support throughout the legal process. We will protect your interests in and beyond the court room.
